Matthew Hibbard, Jack Didley's bouncer back in court
BENTON COUNTY, Wash. - Matthew Hibbard was back in court today pleading not guilty to third degree assault with aggravating circumstances.

This means prosecutors believe his actions were not intentional, but did result in a severe injury to Ben Ensign.

Today, a judge decided statements made to police at the time of his arrest will be allowed during trial.

Investigators say Hibbard violently removed Ensign from Jack Didley's on the Fourth of July causing a traumatic brain injury.

Ensign is still recovering but no longer in the hospital.

Hibbard's trial is set for late January.
